Season Ticket Terms & Conditions (Season 2019/20)

1 Issue of Season Ticket

1.1 The issue of a Season Ticket and subsequent access to the Ground is subject to the Terms Premier League & Conditions of Entry (which can be found on - or accessed via - the Club's website at brightonandhovealbion.com or can be provided upon written request to the Club).

1.2 Season Tickets are for the use of supporters of the Club only. By applying for a Season Ticket and/or using the same you hereby warrant and represent that you are a supporter of the Club.

1.3 MyAlbion+ Members and Brighton & Hove Albion match-ticket purchasers must at all times do everything within their power and control to protect and enhance the good name of the Club and not to diminish or besmirch the good name of the Club in any way or through any means. This includes, but is not restricted to, conduct at any Brighton & Hove Albion fixture, including the first-team, under-23s, women's and academy teams; all club events; while travelling to and from any match or event; and conduct on social media. The Club also does not tolerate foul and/or abusive behaviour towards staff either in person, or via any form of communication with Club staff, including telephone, email and social media. Anybody in breach of these rules, can expect a lengthy and potential life ban, depending on the severity of the breach.

2 Admission to the Ground

2.1 By purchasing and/or accepting and/or holding a Season Ticket and/or using a Season Ticket to gain access to the Ground, you: (a) certify that you have read, understood and accepted; (b) agree to be bound by and to comply with; and (c) agree to bring to the attention of others, as required below, the Terms & Conditions of Entry.

2.2 A Season Ticket permits you to occupy at the Match the seat indicated on the Season Ticket or such other alternative seat of equivalent value as the Club may, from time to time, allocate to you at its reasonable discretion. All access to the Ground pursuant to a Season Ticket shall be for the purposes of private enjoyment of the Match only, not for any commercial purpose (and no authorisation is given or implied in respect of the carrying out of any commercial activities).

2.3 Nothing in these Conditions of Issue shall constitute or imply any entitlement to occupy the seat indicated on the Season Ticket in any subsequent season.

2.4 Save as set out in clause 2.5 below, you shall not capture, log, record, transmit, play, issue, show or otherwise communicate (by digital or other means) any Material in relation to the Match, any players or other persons present in the Ground and/or the Ground, nor may you bring into the Ground or use within the Ground (or provide to, facilitate or otherwise assist another person to use within the Ground) any equipment or technology which is capable of capturing, logging, recording, transmitting, playing, issuing, showing or otherwise communicating (by digital or other means) any such Material. Any person acting in breach of this provision may have such equipment or technology confiscated and/or will be required to deliver up any tapes, films, disks, memory cards, memory sticks or other recordings of the Material (and all copies thereof) in whatever form, to the Premier League and/or the Club and the copyright, database right and all other rights, title and interest in and to all Material is hereby assigned to the Premier League, including by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs and Patents Act 1988. You further agree (if and whenever required to do so by the Premier League) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to the Premier League absolutely and with full title guarantee. In addition, the Club reserves the right to eject you from the Ground in circumstances where you breach this paragraph 2.4.

2.5 Mobile telephones and other mobile devices are permitted within the Ground, PROVIDED THAT (a) they are used for personal and private use only (which, for the avoidance of doubt and by way of example only, shall not include the capturing, logging, recording, transmitting, playing, issuing, showing, or any other communication of any Material for any commercial purposes); and (b) no Material that is captured, logged, recorded, transmitted, played, issue, shown or otherwise communicated by a mobile telephone or other mobile device may be published or otherwise made available to any third parties including, without limitation, via social networking sites.

2.6 The copyright, database right and all other rights, title and interest in and to all Material that you produce at the Ground in relation to the Match, any players or other persons present in the Ground and/or the Ground (whether produced in breach of clause 2.4 above, or pursuant to clause 2.5 above, or otherwise) is hereby assigned to the Premier League, including by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs and Patents Act 1988. You further agree (if and whenever required to do so by the Premier League) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to the Premier League absolutely and with full title guarantee.

2.7 Save for official Club merchandise and/or other football-related clothing worn in good faith, you shall not bring into, use, wear, or display within the Ground any sponsorship, promotional or marketing materials.

2.8 You shall not offer or distribute (either free or for sale by any person) within the Ground any consumer article or commercial product of any nature. For the avoidance of doubt this clause shall not prevent the lawful distribution of text publications in any format which do not infringe clause 2.6 above where both the content and the publication are lawful in all respects and do not in the Club’s reasonable opinion constitute a threat to public order.

2.9 The Club reserves the right to refuse admission to, or eject from, the Ground any person who fails to comply with the Terms & Conditions of Entry.

2.10 Without prejudice to the representation at clause 1.2 above, and in light of the Season Ticket holders being grouped together in designated areas, any attempt to gain access to the Ground wearing or carrying apparel (including, without limitation, hats and/or scarves) that demonstrate support for the Away Club, may result in admission being refused or you being ejected from the Ground and in such circumstances no refund or alternative seat will be offered.

2.11 Children under 12 are not permitted to attend a match at the Amex unless accompanied by an adult 18 years and over. Children up to 2 years old (24 months), are not required to have their own seat and may sit on the lap of their parent/guardian. Lap children can only be held by an adult aged 18 years and over. Only one lap child is allowed per adult. If one adult is attending with more than one infant under 2 years of age, a seat will have to be purchased for each additional infant. Alternatively a seat may be purchased for an infant. Children over 24 months must have their own ticket and assigned seat.

2.12 The Club reserves the right to carry out bag and/or other security checks in respect of Ticket Holders. Details of items that are not permitted inside the stadium can be found in the club charter and these items will not be permitted in to the stadium.

2.13 Season Ticket Holders are not entitled to re-enter the Stadium if they leave the Stadium at any time on a Match day.

3 Use of Season Ticket

3.1 Subject to clause 3.2, below, Season Tickets are issued for your sole use and you shall not sell, dispose of, assign, transfer, lend or otherwise deal with the Season Ticket or the benefit of it to any other person without the prior written consent of the Club. Further you shall not use the Season Ticket for any commercial purpose. The reference to selling the Season Ticket includes: (a) offering to sell a Season Ticket (including, without limitation, via any website or online auction site); (b) exposing a Season Ticket for sale; (c) making a Season Ticket available for sale by another person; (d) advertising that a Season Ticket is available for purchase, which for the avoidance of doubt (and by way of example only) means that this Season Ticket may not be offered as a prize in any promotion or competition; (e) transferring, lending or selling a Season Ticket to any third party as part of a hospitality or travel package; and (f) giving (or offering to give) a Season Ticket to a person who pays or agrees to pay for some other goods or services (or offers to do so); all save as expressly authorised by the Premier League or the Club.

3.2 You may only sell or transfer the Season Ticket:

  • 3.2.1 to a Guest with the express written consent of the Club given at the Club's absolute discretion, provided that such sale or transfer is in respect of an individual Match and in consideration of no payment or benefit in excess of the face value of a ticket to that Match and provided further that such transfer does not take place during the course of any business or for the purpose of facilitating any third party's business; and/or
  • 3.2.2 to any person without the express written consent of the Club, provided that such sale or transfer is in respect of an individual Match and is made via (and in accordance with the terms and conditions of) the Official Ticket Exchange only,
each such resale or transfer is hereby provided to be subject to the Terms and Conditions of Entry which will (save for any rights to transfer under this clause) apply to and bind the recipient of the Season Ticket as if he/she was the original purchaser of the Season Ticket (and where the Season ticket is sold or transferred to a Guest pursuant to clause 3.2.1 you must inform them of this). Any such transfers in respect of an individual match for which the guest is of a different, higher value age band, will be charged an upgrade fee in order to enter the ground. Any such upgrades can be processed no more than six times per season ticket holder per season and will be charged at the price of the match ticket minus the pro-rata value of the season ticket, rounded up to the nearest £.

3.3 The unauthorised sale or disposal of a Season Ticket may amount to a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. The Club will inform the police when it becomes aware that a Season Ticket has been sold or disposed of illegally and will press for charges to be brought against those breaking this law. If you are convicted of a ticket touting offence, or we reasonably suspect you have committed such an offence, we will notify the Premier League who may in turn notify other football clubs, event holders and/or the relevant law enforcement authorities. The information that we share may include your personal data, including your name, contact details, information about the offence and about ticket purchases (including payment details). We will use this to identify and prevent ticket touting offences and disorder at matches.

3.4 The Season Ticket will remain the property of the Club at all times and must be produced together with evidence of your identity if required to do so by any official, steward or employee of the Club or any police officer. The Club reserves the right to require the immediate return of the Season Ticket at any time.

3.5 Any Season Ticket obtained or used in breach of the Terms & Conditions of Entry shall be automatically void and all rights conferred or evidenced by such Season Ticket shall be nullified. Any person seeking to use a Season Ticket in breach of the Terms and Conditions of Entry in order to gain entry to the Ground or remain at a Match will be considered to be a trespasser and will be refused entry to, or ejected from, the Ground in respect of a particular Match and/or may have his/her Season Ticket cancelled or withdrawn. In the event of any cancellation and withdrawal in accordance with this clause 3.5, no refund shall be payable to the holder in respect of any unexpired portion of the Season Ticket. The Club further reserves its right to take any legal or disciplinary action against any person(s) as it sees fit in connection with such matters, including a claim for an account of any profits made from an unauthorised use of the Season Ticket.

3.6 The Club shall have no liability to a Season Ticket holder (or any Guest) for (i) any interruptions and/or restrictions to the view of any match; and/or (ii) any impact on the Season Ticket holder’s (or an Guest’s) enjoyment of any match; in each case which is caused by: (1) the position of the Season Ticket holder’s allocated seat; and/or (2) a camera or other filming device(s); and/or (3) the match officials, stewards, police, coaching or catering staff; and/or (4) other ticket holders in the Stadium

3.7 The Club reserves the right to cancel season ticket holders, in the event the season ticket is used for less than 25% of the home league matches, this will be assessed after ten home league matches have been played.

4 Changes to Dates, Refunds & Exchanges

4.1 No guarantees can be given by the Club that a Match will take place at a particular time or on a particular date. The Club reserves the right to reschedule any Match without notice and without any liability whatsoever. Your Season Ticket will enable you to attend the re-arranged Match.

4.2 The Club will have no further liability whatsoever, including (but not limited to) any indirect or consequential loss or damage, loss of enjoyment or travel/accommodation costs.

4.3 We do not offer refunds on Season tickets unless under exceptional circumstances (with the exception of the limited conditions for auto-renewed direct debit season tickets, see Direct Debit Terms & Conditions below). For the avoidance of doubt, the final decision belongs to the Head of Ticketing & Supporter Services.

5 Lost or Stolen Season Tickets

5.1 In order to gain admission to the Ground the Season Ticket must be presented at every Match.

5.2 In the event that you forget your Season Ticket in respect of any individual Match, the Club shall not be obliged to admit you or issue any other form of ticket for that Match. If a match-day duplicate ticket is issued, the Club may require payment of a non-refundable administration charge.

5.3 If, in the Club's opinion, a Season Ticket is damaged, lost, stolen or destroyed, a duplicate Season Ticket shall be issued by the Club as soon as reasonably practicable after the payment of a £15 non-refundable administration charge (this charge also applies for seat ticket seat moves where a new card is issued). In making its decision, the Club shall be entitled to call for all reasonable evidence of the need for a replacement Season Ticket, for example but not limited to a police crime reference number in the event that a Season Ticket is stolen, or a copy of the damaged Season Ticket. Only one duplicate Season Ticket will be issued to you per season and you will be required to sign a document confirming that the original Season Ticket is damaged, lost, stolen or destroyed and indemnifying the Club against any direct or indirect consequences of such matter having been falsely represented or stated to the Club.

5.4 Should any Season Ticket when applied for not arrive in the post after purchase, you will be required to sign a document confirming this and undertaking to immediately return the original Season Ticket to the Club should it come into your possession at any time. There will be no charge for the issue of a duplicate Season Ticket in this instance.

6 Change of Address

6 If you change your address during the season you must notify the Club as soon as reasonably practicable by emailing supporter.services@bhafc.co.uk or changing your details at www.brightonandhovealbion.com.

7 Cancellation & Withdrawal of Season Ticket

7.1 Without prejudice to any other remedies it may have, the Club shall have the right in the case of any serious or persistent breach of the Terms & Conditions of Entry to cancel and withdraw your Season Ticket and to eject you from the Ground. In the event of such cancellation no refund will be paid in respect of any unexpired portion of the Season Ticket. Without prejudice to the general nature of the above the following actions shall constitute serious breach of the Terms & Conditions of Entry:
  • 7.1.1 smoking in designated non-smoking areas;
  • 7.1.2 being (or appearing to be) intoxicated;
  • 7.1.3 persistent standing in seated areas whilst the Match is in progress;
  • 7.1.4 the sale or transfer (save as permitted) of a Season Ticket to any person;
  • 7.1.5 the possession of a banner or flag that bears material or slogans that are offensive, obscene, abusive or racist;
  • 7.1.6 the deliberate misuse of a Season Ticket;
  • 7.1.7 the supply of any misleading or incorrect information in any application including, but not limited to, the setting up of a duplicate account where the owner has previously been blocked/banned in order to obtain Match tickets;
  • 7.1.8 the throwing of any object within the Ground that may cause injury, damage, distress or annoyance to people or property without lawful authority or excuse;
  • 7.1.9 whether at the Ground, or, travelling to or from a Match:
    • 7.1.9.1 the use of foul, obscene, abusive and/or racist language and/or gestures;
    • 7.1.9.2 the chanting of anything of an indecent or racist nature;
    • 7.1.9.3 fighting or engaging in and/or inciting violence;
  • 7.1.10 bringing into the Ground (or using within the Ground): illegal drugs, other illegal substances, fireworks, firecrackers, smoke canisters, air horns, flares, laser devices, bottles, glass vessels or any item that might be used as a weapon or compromise public safety;
  • 7.1.11 entering the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse;
  • 7.1.12 any misrepresentation in relation to clause 1.2 above;
  • 7.1.13 breach of the terms of any Membership;
  • 7.1.14 any breach of clauses 2.4, 2.5 or 2.6 above; and
  • 7.1.15 any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of any Season Ticket.
7.2 The Club may conduct security searches where it has reason to believe that any of the breaches set down in 7.1 has either occurred or may occur.

7.3 If a Season Ticket holder is not 16 years old or over, his/her parent(s) and/or guardian(s) are responsible for his/her actions, conduct and compliance with the Terms and Conditions of Entry.

7.4 In the event that your Season Ticket is withdrawn or cancelled the Club reserves the right to exclude you from any membership scheme maintained or organised by the Club and/or to disqualify you from applying for any Match ticket or season ticket at its discretion, and to notify any Football Authority and/or other football clubs of such exclusion and/or disqualification (and the reason(s) for such exclusion and/or disqualification).

8 Filming, photography and taping

8.1 All Season Ticket holders who enter the Ground acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be taken of them and may also be used, by way of example and without limitation, in televised coverage of the game and/or for promotional, training, editorial or marketing purposes by the Club, the Premier League, or others (including commercial partners and accredited media organisations), and use of a Season Ticket to enter the Ground constitutes consent to such use. You further acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be used (by the Club or by a third party, such as a law enforcement body) to identify you as an individual, where permitted by data protection laws, for the purposes of preventing or detecting crime, or any breach of these Conditions of Issue or the Terms & Conditions of Entry.

8.2 All Season Ticket holders agree that the Matches for which Season Tickets have been purchased are public, and that their appearance and actions inside and in the perimeter of the Ground where a Match occurs are public in nature, and that they shall have no expectation of privacy with regard to their actions or conduct at Matches.

9 Exclusion of Liability

9.1 The Club hereby excludes any liability for loss, injury or damage to persons/property in or around the Ground except in respect of death or personal injury resulting from any negligence of the Club or any other liability of the Club which cannot be excluded under applicable law.

9.2 Neither the Premier League nor the Club shall be responsible for any interruptions and/or restrictions to the view of the Match caused by virtue of (a) the position of the seat and/or (b) the actions of other spectators.

9.3 The Club hereby excludes any liability for any loss, injury, costs, expenses or damage of any kind connected to your use of the Official Ticket Exchange, including, without limitation, any liability relating to any problem with, suspension of or termination of the Official Ticket Exchange, in each case except in respect of death or personal injury resulting from any negligence of the Club or any other liability of the Club which cannot be excluded under applicable law.

10 General

10.1 The Club reserves the right to change these Conditions of Issue from time to time, and shall notify you of such changes if they materially affect your rights as a consumer.

10.2 You acknowledge that the Club will hold and process data relating to you, which may include personal data, for administrative and legal purposes. The personal data that you provide to the Club shall be processed, stored and transferred in accordance with the terms of the Club's then current privacy policy available from www.BrightonAndHoveAlbion.com.

10.3 The invalidity or partial invalidity of any provision of these Conditions of Issue shall not prejudice or affect the remainder of these Conditions of Issue, which shall continue in full force and effect. If any invalid, unenforceable or illegal provision of this agreement would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.

10.4 The Club's failure to exercise, or delay in exercising, any right, power or remedy provided by these Conditions of Issue or by law shall not constitute a waiver of that right, power or remedy.

10.5 The Terms and Conditions of Entry constitute the entire agreement between the Club and the Season Ticket holder and neither the Club nor the Season Ticket holder shall have any claim or remedy in respect of any statement, representation, warranty or undertaking made by or on behalf of any other party in relation to the Terms and Conditions of Entry which is not set out therein.

10.6 If there is any conflict, ambiguity or inconsistency between any provision of these Conditions of Issue and any provision of the Ground Regulations, the relevant provision of these Conditions of Issue shall take precedence.

10.7 Notwithstanding any other provision in these Conditions of Issue and with the exception of any Football Authority, no other person other than you or the Club has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Conditions of Issue. Nothing in these terms of conditions shall affect any right or remedy of a third party that exists or is available other than as a result of the aforementioned Act.

10.8 These Conditions of Issue shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales (including in relation to any non-contractual disputes or claims).

Governing Law

These Conditions of Issue shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales.

Definitions

In the Conditions of Issue the following words and phrases shall have the following meanings:

"Away Club" means the football club playing against the Club.

"Conditions of Issue" means these terms and conditions governing the issue and use of a Season Ticket.

"Football Authority" means each of the Premier League, The Football League, The Football Association, The Football Association of Wales, FIFA, UEFA and other relevant governing body of association football.

"Ground" means the football stadium and all other locations owned, occupied or utilised by the Club.

"Ground Regulations" means those ground regulations issued by the Club from time to time that set out the terms and conditions upon which spectators are granted entry to the Ground.

"Guest" means a relative, friend, colleague and/or companion to the disabled who would be entitled to purchase a Season Ticket under the Terms & Conditions of Entry.

"Match" means any Premier League/Football League football match in which the Club participates and that takes place at the Ground during Season 2019-2020.

"Material" means any audio, visual or audio-visual material or any information or data.

"Membership" means any rules and regulations agreed in relation to your participation in the Club's membership scheme which can be found at brightonandhovealbion.com.

"Official Ticket Exchange" means the Club's authorised ticket resale facility

"Season Ticket" means a season ticket booklet (and all or any component vouchers therein) or any season ticket smartcard (and/or any rights arising out of or in connection with any of the foregoing) for admission to Matches.

"Terms & Conditions of Entry" means each of the rules and regulations of any Football Authority; the Ground Regulations; and the Conditions of Issue.

Direct Debit Terms & Conditions (Season 2019/20)

1. The issue and use of a Smartcard Season Ticket is subject to the Terms & Conditions of Entry and conditional upon payment of the Season Ticket Fee in cleared funds in advance or by Direct Debit in accordance with paragraph 2 below.

2. Where a Direct Debit Customer elects to pay by monthly Direct Debit the Season Ticket Fee shall be due and payable in 12 equal instalments monthly in advance, beginning in April prior to the Season in which the Season Ticket will be used and ending in March the following year.

Direct Debit Customers must be over 18, hold a valid UK bank account and have not previously breached the Terms & Conditions of Entry or the Direct Debit Terms and Conditions. Submission to the Club of a valid Direct Debit instruction shall be confirmation that the Direct Debit Customer has elected to make payment by Direct Debit and agrees to be bound by these Direct Debit Terms and Conditions.
Direct Debit Customers can purchase Season Tickets for use by their children under the age of 18 but they remain responsible for the conduct of the user of such Season Ticket including without limitation their compliance with the Terms & Conditions of Entry.

3. The Direct Debit Customer must keep the Club informed of any changes to the bank account or payment card and any other details provided in the Direct Debit instruction. If the Club attempts to use the details provided and a card or payment request is declined:

  • (i) the Smartcard Season Ticket purchased by the Direct Debit Customer shall be deactivated and the Stadium Access System will deny entry to Matches until the Club receives the overdue instalment payment(s) in full (the Direct Debit Customer will also not be able to purchase tickets on a match-by-match basis during this time);
  • (ii) the Direct Debit Customer will be liable to pay a £10 administration charge, plus any other resulting bank charge or reasonable administrative expense incurred by the Club; and
  • (iii) if two or more payment requests are declined  the provisions of paragraph 4 below will also apply.
3.1 Direct Debit Customers who no longer wish to pay for their Season Ticket by Direct Debit can cancel their Direct Debit at any time, as outlined in the Direct Debit Guarantee. If the Direct Debit Customer cancels their Direct Debit he/she must make alternative arrangements within 7 days for payment of the remaining monthly payments connected to their Season Ticket.

4. If two or more Direct Debit payments have not been received by the Club for any reason, the Club shall notify the Direct Debit Customer and the Club may at its option suspend the use of the Smartcard Season Ticket purchased by the Direct Debit Customer and all associated benefits until all overdue payments are paid in full. 
If the overdue payments have not been paid in full within 14 days of the Club's notice the Club shall be entitled to:
  • (i) cancel the Season Ticket purchased by the Direct Debit Customer, following which the Smartcard Season Ticket shall be deactivated and the Stadium Access System will automatically deny entry to any subsequent Matches; and
  • (ii) take such action as it deems necessary to recover overdue instalments at the date of such cancellation plus any reasonable costs of recovering such amounts; and
  • (iii) where the Direct Debit Customer has not provided a notice of cancellation prior to 2 August in accordance with paragraph 8 below, take such action as it deems necessary to recover future instalments that would otherwise have fallen due had the Season Ticket not been cancelled (provided that the Club will use reasonable endeavours to mitigate its loss in respect of such future instalments).
The Direct Debit Customer has a right of appeal against any such suspension and/or cancellation in accordance with paragraph 5.

5. If a Season Ticket purchased by a Direct Debit Customer is suspended or cancelled in accordance with the provisions of paragraph 4, the Direct Debit Customer shall be entitled to appeal to the Club against the suspension or cancellation (as appropriate), within a period of three (3) months from the date of cancellation. Appeals should: (i) be in writing; (ii) be marked for the attention of "Ticket Office Manager"; and (iii) set out the reasons for the appeal and why the Direct Debit Customer believes the Season Ticket should be reinstated. The Club shall respond to the appeal in writing setting out its decision. The Club's decision shall be final.

6. Unless the Direct Debit Customer has expressly indicated otherwise when purchasing the Season Ticket, the Direct Debit Customer agrees to the automatic renewal of their Season Ticket for subsequent Seasons in accordance with paragraph 7.

7.1 Where the purchase of a Season Ticket is made via the Club's ticketing telephone line or ticketing website, all Direct Debit Customers have the legal right to cancel their Season Ticket by notifying the Club in writing, within 14 days of purchasing a Season Ticket and submitting a completed Direct Debit instruction, without any charge or liability to make further monthly payments.

7.2 Direct Debit Customers whose existing Season Tickets have automatically renewed may cancel their Season Ticket prior to 5pm on 1 August in the relevant year, without liability to make further monthly payments. The Direct Debit Customer must provide the Club with a written cancellation notice and pay the cancellation fee to cover the Club's reasonable administration costs, as follows:
  • (a)£10 cancellation fee where the cancellation notice is received by the Club between 5pm on 13 March and 19 April (inclusive) in the relevant year;
  • (b)£50 cancellation fee where the cancellation notice is received by the Club between 5pm 19 April and 5pm 1 August (inclusive) in the relevant year.
Payment of the cancellation fee is required in the first instance so that any amounts paid by Direct Debit towards the Season Ticket may be refunded.

7.3 Subject to clause 7.1, following the setting up of a new Direct Debit for a new Season Ticket in the relevant year, Direct Debit Customers are required to pay all outstanding monies that would have fallen due as monthly payments for the remainder of that Season.

7.4 Subject to clause 7.1, all Season Ticket payments are non-refundable except in exceptional circumstances where the Club may, at its sole discretion, agree to grant a full or partial refund. Refunds may be subject to the deduction of a fee to cover the administration costs incurred by the Club in processing such a refund (currently £50) and will be paid by cheque or reversed Direct Debit.

8. Nothing in these Terms and Conditions gives any guarantee that a Direct Debit Customer will be entitled to renew their Season Ticket or purchase a Season Ticket in any subsequent Season.

Home Match Ticket Conditions of Issue

1. Issue of Home Match Ticket

1.1 The issue of a Home Match Ticket and subsequent access to the Ground is subject to the Terms & Conditions of Entry (which can be found on - or accessed via - the Club's website at brightonandhovealbion.com or can be provided upon written request to the Club).

1.2 Home Match Tickets are for the use of supporters of the Club only. By applying for the Home Match Ticket and/or using the same you hereby warrant and represent that you are a supporter of the Club and/or that you are not a supporter of the Visiting Club.

1.3 MyAlbion Members and Brighton & Hove Albion match-ticket purchasers must at all times do everything within their power and control to protect and enhance the good name of the Club and not to diminish or besmirch the good name of the Club in any way or through any means. This includes, but is not restricted to, conduct at any Brighton & Hove Albion fixture, including the first-team, under-21s, women's and academy teams; all club events; while travelling to and from any match or event; and conduct on social media. The Club also does not tolerate foul and/or abusive behaviour towards staff either in person, or via any form of communication with Club staff, including telephone, email and social media. Anybody in breach of these rules, can expect a lengthy and potential life ban, depending on the severity of the breach.

2. Admission to the Ground

2.1 By purchasing and/or accepting and/or holding a Home Match Ticket and/or using a Home Match Ticket to gain access to the Ground, you: (a) certify that you have read, understood and accepted; (b) agree to be bound by and to comply with; and (c) agree to bring to the attention of others, as required below, the Terms & Conditions of Entry.

2.2 A Home Match Ticket permits you to occupy at the Match the seat indicated on the Home Match Ticket or such other alternative seat of equivalent value as the Club may allocate to you at its reasonable discretion. All access to the Ground pursuant to a Home Match Ticket shall be for the purposes of private enjoyment of the Match only, not for any commercial purpose (and no authorisation is given or implied in respect of the carrying out of any commercial activities).

2.3 Nothing in these Conditions of Issue shall constitute or imply any entitlement to occupy the seat indicated on the Home Match Ticket in any subsequent Match or season.

2.4 Save as set out in clause 2.5 below, you shall not capture, log, record, transmit, play, issue, show or otherwise communicate (by digital or other means) any Material in relation to the Match, any players or other persons present in the Ground and/or the Ground, nor may you bring into the Ground or use within the Ground (or provide to, facilitate or otherwise assist another person to use within the Ground) any equipment or technology which is capable of capturing, logging, recording, transmitting, playing, issuing, showing or otherwise communicating (by digital or other means) any such Material. Any person acting in breach of this provision may have such equipment or technology confiscated and/or will be required to deliver up any tapes, films, disks, memory cards, memory sticks or other recordings of the Material (and all copies thereof) in whatever form, to the Premier League and/or the Club and the copyright, database right and all other rights, title and interest in and to all Material is hereby assigned to the Premier League, including by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs and Patents Act 1988. You further agree (if and whenever required to do so by the Premier League) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to the Premier League absolutely and with full title guarantee. In addition, the Club reserves the right to eject you from the Ground in circumstances where you breach this paragraph 2.4.

2.5 Mobile telephones and other mobile devices are permitted within the Ground PROVIDED THAT (a) they are used for personal and private use only (which, for the avoidance of doubt and by way of example only, shall not include the capturing, logging, recording, transmitting, playing, issuing, showing, or any other communication of any Material for any commercial purposes); and (b) no Material that is captured, logged, recorded, transmitted, played, issued, shown or otherwise communicated by a mobile telephone or other mobile device may be published or otherwise made available to any third parties including, without limitation, via social networking sites.

2.6 The copyright, database right and all other rights, title and interest in and to all Material that you produce at the Ground in relation to the Match, any players or other persons present in the Ground and/or the Ground (whether produced in breach of clause 2.4 above, or pursuant to clause 2.5 above, or otherwise) is hereby assigned to the Premier League, including by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs and Patents Act 1988. You further agree (if and whenever required to do so by the Premier League) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to the Premier League absolutely and with full title guarantee.

2.7 Save for official Club merchandise and/or other football related clothing worn in good faith, you shall not bring into, use, wear, or display within the Ground any sponsorship, promotional or marketing materials.

2.8 You shall not offer or distribute (either free or for sale by any person) within the Ground any consumer article or commercial product of any nature. For the avoidance of doubt this clause shall not prevent the lawful distribution of text publications in any format which do not infringe clause 2.6 above where both the content and the publication are lawful in all respects and do not in the Club's reasonable opinion constitute a threat to public order.

2.9 The Club reserves the right to refuse admission to, or eject from, the Ground any person who fails to comply with the Terms & Conditions of Entry.

2.10 Without prejudice to the representation at clause 1.2, above, and in light of the Home Match Ticket holders being grouped together in designated areas, any attempt to gain access to the Ground wearing or carrying apparel (including, without limitation, hats and/or scarves) that demonstrate support for the Visiting Club, may result in admission being refused or you being ejected from the Ground and in such circumstances no refund or alternative seat will be offered.
2.11 Children under 12 are not permitted to attend a match at the Amex stadium unless accompanied by an adult 18 years and over. Children up to 2 years old (24 months), are not required to have their own seat and may sit on the lap of their parent/guardian. Lap children can only be held by an adult aged 18 years and over. Only one lap child is allowed per adult. If one adult is attending with more than one infant under 2 years of age, a seat will have to be purchased for each additional infant. Alternatively a seat may be purchased for an infant. Children over 24 months must have their own ticket and assigned seat.

2.12 The Club reserves the right to carry out bag and/or other security checks in respect of Ticket Holders. Details of items that are not permitted inside the stadium can be found in the club charter and these items will not be permitted in to the stadium.

2.13 Ticket Holders are not entitled to re-enter the Stadium if they leave the Stadium at any time on a Match day.

3. Use of Home Match Ticket

3.1 Subject to clause 3.3, below, the Home Match Ticket is issued for your sole use and you shall not sell, dispose of, assign, transfer or otherwise deal with the Home Match Ticket or the benefit of it to any other person without the prior written consent of the Club. Further you shall not use the Home Match Ticket for any commercial purpose. The reference to selling the Home Match Ticket includes: (a) offering to sell a Home Match Ticket (including, without limitation, via any website or online auction site); (b) exposing a Home Match Ticket for sale; (c) making a Home Match Ticket available for sale by another person; (d) advertising that a Home Match Ticket is available for purchase, which for the avoidance of doubt (and by way of example only) means that this Home Match Ticket may not be offered as a prize in any promotion or competition; (e) transferring, lending or selling a Home Match Ticket to any third party as part of a hospitality or travel package; and (f) giving (or offering to give) a Home Match Ticket to a person who pays or agrees to pay for some other goods or services (or offers to do so); all save as expressly authorised by the Premier League or the Club.

3.2 The unauthorised sale or disposal of a Home Match Ticket may amount to a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. The Club will inform the police when it becomes aware that a Home Match Ticket has been sold, or disposed of illegally and will press for charges to be brought against those breaking this law. If you are convicted of a ticket touting offence, or we reasonably suspect you have committed such an offence, we will notify the Premier League who may in turn notify other football clubs, event holders and/or the relevant law enforcement authorities. The information that we share may include your personal data, including your name, contact details, information about the offence and about ticket purchases (including payment details). We will use this to identify and prevent ticket touting offences and disorder at matches.

3.3 If more than one Home Match Ticket is issued to you, one Home Match Ticket must be retained by you, for personal use (subject to the provisions below) and the remainder may be transferred to your Guest(s) for his/her/their personal use only PROVIDED THAT such transfer takes place in consideration of no payment or benefit in excess of the face value of the Home Match Ticket, and such transfer does not take place in the course of any business or for the purpose of facilitating any third party's business. Such transfer to any Guest will be subject to the Terms & Conditions of Entry which will (save for any rights to transfer under this clause or any rights to a refund under clause 4.3 below) apply to and bind each Guest as if he/she was the original purchaser of the Home Match Ticket (and you must inform the Guest(s) of this). You will provide the name and address of your Guest(s) when asked to do so by any official, steward or employee of the Club and/or any police officer. In the event that you and/or your Guest(s) are unable to use any Home Match Ticket then you may transfer that Home Match Ticket(s), with the express written consent of the Club given at the Club's absolute discretion, to a natural person who is known to you personally and who would be entitled (under the Terms & Conditions of Entry and otherwise) to purchase such Home Match Ticket and attend such Match PROVIDED THAT such transfer takes place in consideration of no payment or benefit in excess of the face value of the Home Match Ticket, and such transfer does not take place in the course of any business or for the purpose of facilitating any third party's business. Such transfer will be subject to the Terms & Conditions of Entry which will (save for any rights to transfer under this clause or any rights to a refund under clause 4.3 below) apply to and bind the transferee as if he was the original purchaser of the Home Match Ticket (and you must inform the transferee of this). You will provide the name and address of the transferee when asked to do so by any official, steward or employee of the Club and/or any police officer.

3.4 The Home Match Ticket will remain the property of the Club at all times and must be produced together with evidence of your identity if required to do so by any official, steward or employee of the Club or any police officer. The Club reserves the right to require the immediate return of the Home Match Ticket at any time.

3.5 Any Home Match Ticket obtained or used in breach of the Terms & Conditions of Entry shall be automatically void and all rights conferred or evidenced by such Home Match Ticket shall be nullified. Misuse of this Home Match Ticket may result in the holder being refused entry to, or ejected from, the Ground in respect of a particular Match and/or the cancellation and withdrawal of this Home Match Ticket. In the event of any cancellation and withdrawal in accordance with this clause 3.5, no refund shall be payable. The Club further reserves its right to take any legal action against any persons as it sees fit in connection with such matters, including a claim for an account of profits made from an unauthorized use of the Home Match Ticket.

3.6 The Club shall have no liability to a Match Ticket holder for (i) any interruptions and/or restrictions to the view of any match; and/or (ii) any impact on the Match Ticket holder’s enjoyment of any match; in each case which is caused by: (1) the position of the Match Ticket holder’s allocated seat; and/or (2) a camera or other filming device(s); and/or (3) the match officials, stewards, police, coaching or catering staff; and/or (4) other ticket holders in the Stadium.

4. Changes to Dates, Refunds & Exchanges

4.1 No guarantees can be given by the Club that the Match will take place at a particular time or on a particular date. The Club reserves the right to reschedule any Match without notice and without any liability whatsoever, other than that detailed in Clause 4.2.

4.2 In the event of the postponement or abandonment of the Match (or if the Match has, for any reason, to be played out of view of the public), you will be entitled to receive a full refund (including any booking and/or administration fee) or receive the equivalent ticket for the subsequent re-arranged Match via such application procedure as the Club stipulates. The Club will have no further liability whatsoever, including (but not limited to) any indirect or consequential loss or damage, loss of enjoyment or travel/accommodation costs.

4.3 In order to obtain a refund, the Home Match Ticket must be returned to the Club's ticket office within 7 days of the rescheduling announcement (which shall be made on the club website) provided this is still more than 7 days before the rescheduled date. Tickets that include hospitality are subject to their own terms and conditions. It is the responsibility of the ticket holder to check the date and kick off time of matches. A refund will only be issued on production of identification that the individual requesting the refund is the person to whom the Home Match Ticket was originally sold. For the avoidance of doubt, the final decision belongs to the Ticket Office Manager.

5. Lost or Stolen Home Match Tickets

5.1 In order to gain admission to the Ground the Home Match Ticket must be presented in its entirety at the Match.

5.2 The Club shall not be obliged to issue any replacement for a lost, stolen or destroyed Home Match Ticket.

6. Cancellation & Withdrawal of Home Match Ticket

6.1 Without prejudice to any other remedies it may have, the Club shall have the right in the case of any serious or persistent breach of the Terms & Conditions of Entry to cancel and withdraw any Home Match Ticket issued to you. In the event of such cancellation no refund will be paid. Without prejudice to the general nature of the above, the following actions shall constitute serious breach of the Terms & Conditions of Entry:

  • 6.1.1 smoking in designated non-smoking areas;
  • 6.1.2 being (or appearing to be) drunk or intoxicated;
  • 6.1.3 persistent standing in seated areas whilst the Match is in progress;
  • 6.1.4 the sale or transfer (save as permitted) of a Home Match Ticket to any person;
  • 6.1.5 the deliberate misuse of a Home Match Ticket;
  • 6.1.6 any misrepresentation in relation to clause 1.2 above;
  • 6.1.7 the possession of a banner or flag that bears material or slogans that are offensive, obscene, abusive or racist;
  • 6.1.8 the throwing of any object within the Ground that may cause injury, damage, distress or annoyance to people or property without lawful authority or excuse;
  • 6.1.9 whether at the Ground, or, travelling to a Match:
    • 6.1.9.1 the use of foul, obscene, abusive and/or racist language and/or gestures;
    • 6.1.9.2 the chanting of anything of an indecent or racist nature ;
    • 6.1.9.3 fighting, or engaging in and/or inciting violence;
  • 6.1.10 bringing any of the following into the Ground (or using them within the Ground): illegal drugs; other illegal substances; fireworks; firecrackers; smoke canisters; air horns; flares; laser devices; bottles; glass vessels or any item that might be used as a weapon or compromise public safety;
  • 6.1.11 entering the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse;
  • 6.1.12 the supply of any misleading or incorrect information in any application;
  • 6.1.13 any breach of clauses 2.4, 2.5 or 2.6 above; and
  • 6.1.14 any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of any Home Match Ticket
  • 6.1.15 the supply of any misleading or incorrect information in any application including, but not limited to, the setting up of a duplicate account where the owner has previously been blocked/banned;

6.2 The Club may conduct security searches where it has reason to believe that any of the breaches set down in 6.1 has either occurred or may occur.

6.3 If a Home Match Ticket holder is not 16 years old or over, his/her parent(s) and/or guardian(s) are responsible for his/her actions, conduct and compliance with the Terms & Conditions of Entry.

6.4 In the event that your Home Match Ticket is withdrawn or cancelled the Club reserves the right to exclude you from any membership scheme maintained or organised by the Club and/or to disqualify you from applying for any Match ticket or season ticket at its discretion and to notify any Football Authority and/or other football clubs of such exclusion and/or disqualification (and the reason(s) for such exclusion and/or disqualification).

7. Filming, photography and taping

7.1 All Home Match Ticket holders who enter the Ground acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be taken of them and may also be used, by way of example and without limitation, in televised coverage of the game and/or for promotional, training, editorial or marketing purposes by the Club, the Premier League or others (including commercial partners and accredited media organisations), and use of a Home Match Ticket to enter the Ground constitutes consent to such use. You further acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be used (by the Club or by a third party, such as a law enforcement body) to identify you as an individual, where permitted by data protection laws, for the purposes of preventing or detecting crime, or any breach of these Conditions of Issue or the Terms & Conditions of Entry.

7.2 All Home Match Ticket holders agree that the Matches for which Home Match Tickets have been purchased are public, and that their appearance and actions inside and in the perimeter of the Ground where a Match occurs are public in nature, and that they shall have no expectation of privacy with regard to their actions or conduct at Matches.

8. Exclusion of Liability

8.1 The Club hereby excludes any liability for loss, injury or damage to persons/property in or around the Ground except in respect of death or personal injury resulting from any negligence of the Club or any other liability of the Club which cannot be excluded under applicable law.

8.2 Neither the Premier League nor the Club shall be responsible for any interruptions and/or restrictions to the view of the Match caused by virtue of (i) the position of the seat and/or (ii) the actions of other spectators.

9. General
9.1 The Club reserves the right to change these Conditions of Issue from time to time, and shall notify you of such changes if they materially affect your rights as a consumer.

9.2 You acknowledge that the Club will hold and process data relating to you, which my include personal data, for administrative and legal purposes. The personal data that you provide to the Club shall be processed, stored and transferred in accordance with the terms of the Club's then current privacy policy available from BrigtonAndHoveAlbion.com.

9.3 The invalidity or partial invalidity of any provision of these Conditions of Issue shall not prejudice or affect the remainder of these Conditions of Issue, which shall continue in full force and effect. If any invalid, unenforceable or illegal provision of this agreement would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.

9.4 The Club's failure to exercise, or delay in exercising, any right, power or remedy provided by these Conditions of Issue or by law shall not constitute a waiver of that right, power or remedy.

9.5 The Terms and Conditions of Entry constitute the entire agreement between the Club and the Home Match Ticket holder and neither the Club nor the Home Match Ticket holder shall have any claim or remedy in respect of any statement, representation, warranty or undertaking made by or on behalf of any other party in relation to the Terms and Conditions of Entry which is not set out therein.

9.6 If there is any conflict, ambiguity or inconsistency between any provision of these Conditions of Issue and any provision of the Ground Regulations, the relevant provision of these Conditions of Issue shall take precedence.

9.7 Notwithstanding any other provision in these Conditions of Issue and with the exception of any Football Authority, no other person other than you or the Club has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Conditions of Issue. Nothing in these terms of conditions shall affect any right or remedy of a third party that exists or is available other than as a result of the aforementioned Act.

9.8 These Conditions of Issue and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales in relation to any dispute or claim arising out of or in connection with these Conditions of Issue (including in relation to any non-contractual disputes or claims).

10. Definitions

In the Conditions of Issue the following words and phrases shall have the following meanings:

"Conditions of Issue" means these terms and conditions governing the issue and use of a Home Match Ticket.

"Football Authority" means each of the Premier League, The Football League, The Football Association, The Football Association of Wales, FIFA, UEFA and other relevant governing body of association football.

"Ground" means the football stadium and all other locations owned, occupied or utilised by the Club.

"Ground Regulations" means those ground regulations issued by the Club from time to time that set out the terms and conditions upon which spectators are granted entry to the Ground.

"Guest" means a relative, friend, colleague and/or companion to the disabled who would be entitled to purchase a Home Match Ticket under the Terms & Conditions of Entry.

"Home Match Ticket" means a printed paper ticket or any other form of ticket (and/or any rights arising out of or in connection with any of the foregoing) for admission to the Match.

"Match" means that Premier League football match in which the Club participates and that takes place at the Ground during Season 2019-2020 as designated upon the ticket to which these Conditions of Issue apply.

"Material" means any audio, visual or audio-visual material or any information or data.

"Terms & Conditions of Entry" means each of the rules and regulations of any Football Authority; the Ground Regulations; and the Conditions of Issue.

"Visiting Club" means the football club playing against the Club.

All access to the Ground pursuant to an Away Match Ticket shall be for the purposes of private enjoyment of the Match only, not for any commercial purpose (and no authorisation is given or implied in respect of the carrying out of any commercial activities).

2.3 Nothing in these Conditions of Issue shall constitute or imply any entitlement to occupy the seat indicated on the Away Match Ticket in any subsequent Match or season.

2.5 Mobile telephones and other mobile devices are permitted within the Ground PROVIDED THAT (a) they are used for personal and private use only (which, for the avoidance of doubt and by way of example only, shall not include the capturing, logging, recording, transmitting, playing, issuing, showing or any other communication of any Material for any commercial purposes); and (b) no Material that is captured, logged, recorded, transmitted, played, issue, shown or otherwise communicated by a mobile telephone or other mobile device may be published or otherwise made available to any third parties including, without limitation, via social networking sites.

2.6 The copyright, database right and all other rights, title and interest in and to all Material that you produce at the Ground in relation to the Match, any players or other persons present in the Ground and/or the Ground (whether produced in breach of clause 2.4 above, or pursuant to clause 2.5 above, or otherwise) is hereby assigned to the Premier League, including by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs and Patents Act 1988. You further agree (if and whenever required to do so by the Premier League) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to the Premier League absolutely and with full title guarantee.

2.7 Save for official Club merchandise and/or other football-related clothing worn in good faith, you shall not bring into, use, wear or display within the Ground any sponsorship, promotional or marketing materials.

2.8 You shall not offer or distribute (either free or for sale by any person) within the Ground any consumer article or commercial product of any nature. For the avoidance of doubt this clause shall not prevent the lawful distribution of text publications in any format which do not infringe clause 2.5 above where both the content and the publication are lawful in all respects and do not in the Club's reasonable opinion constitute a threat to public order.

2.9 The Club reserves the right to refuse admission to, or eject from, the Ground any person who fails to comply with the Terms & Conditions of Entry.

2.10 Without prejudice to the representation at clause 1.2, above, and in light of the Away Match Ticket holders being grouped together in designated areas, any attempt to gain access to the Ground wearing or carrying apparel (including, without limitation, hats and/or scarves) that demonstrate support for the Club, may result in admission being refused or you being ejected from the Ground and in such circumstances no refund or alternative seat will be offered.

3. Use of Away Match Ticket

3.1 Subject to clause 3.3 below, the Away Match Ticket is issued for your sole use and you shall not sell, dispose of, assign, transfer or otherwise deal with the Away Match Ticket or the benefit of it to any other person without the prior written consent of the Club. Further you shall not use the Away Match Ticket for any commercial purpose. The reference to selling the Away Match Ticket includes: (a) offering to sell an Away Match Ticket (including, without limitation, via any website or online auction site); (b) exposing an Away Match Ticket for sale; (c) making an Away Match Ticket available for sale by another person; (d) advertising that an Away Match Ticket is available for purchase, which for the avoidance of doubt (and by way of example only) means that this Away Match Ticket may not be offered as a prize in any promotion or competition; (e) transferring, lending or selling an Away Match Ticket to any third party as part of a hospitality or travel package; and (f) giving (or offering to give) an Away Match Ticket to a person who pays or agrees to pay for some other goods or services (or offers to do so); all save as expressly authorised by the Premier League or the Club.

3.2 The unauthorised sale or disposal of an Away Match Ticket may amount to a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. The Club will inform the police when it becomes aware that an Away Match Ticket has been sold, or disposed of illegally and will press for charges to be brought against those breaking this law. If you are convicted of a ticket touting offence, or we reasonably suspect you have committed such an offence, we will notify the Premier League who may in turn notify other football clubs, event holders and/or the relevant law enforcement authorities. The information that we share may include your personal data, including your name, contact details, information about the offence and about ticket purchases (including payment details). We will use this to identify and prevent ticket touting offences and disorder at matches.

3.3 If more than one Away Match Ticket is issued to you, one Away Match Ticket must be retained by you for personal use (subject to the provisions below) and the remainder may be transferred to your Guest(s) for his/her/their personal use only PROVIDED THAT such transfer takes place in consideration of no payment or benefit in excess of the face value of the Away Match Ticket and such transfer does not take place in the course of any business or for the purpose of facilitating any third party's business. Such transfer to any Guest will be subject to the Terms & Conditions of Entry which will (save for any rights to transfer under this clause or any rights to a refund under clause 4.3 below) apply to and bind each Guest as if he/she was the original purchaser of the Away Match Ticket (and you must inform the Guest(s) of this). You will provide the name and address of your Guest(s) when asked to do so by any official, steward or employee of the Club and/or any police officer. In the event that you and/or your Guest(s) are unable to use any Away Match Ticket then you may transfer that Away Match Ticket(s), with the express written consent of the Club given at the Club's absolute discretion, to a natural person who is known to you personally and who would be entitled (under the Terms & Conditions of Entry and otherwise) to purchase such Away Match Ticket and attend such Match PROVIDED THAT such transfer takes place in consideration of no payment or benefit in excess of the face value of the Away Match Ticket, and such transfer does not take place in the course of any business or for the purpose of facilitating any third party's business. Such transfer will be subject to the Terms & Conditions of Entry which will (save for any rights to transfer under this clause or any rights to a refund under clause 4.3 below) apply to and bind the transferee as if he was the original purchaser of the Away Match Ticket (and you must inform the transferee of this). You will provide the name and address of the transferee when asked to do so by any official, steward or employee of the Club and/or any police officer.

3.4 The Away Match Ticket will remain the property of the Club at all times and must be produced together with evidence of your identity if required to do so by any official, steward or employee of the Club or any police officer. The Club reserves the right to require the immediate return of the Away Match Ticket at any time.

3.5 Any Away Match Ticket obtained or used in breach of the Terms & Conditions of Entry shall be automatically void and all rights conferred or evidenced by such Away Match Ticket shall be nullified. Any person seeking to use an Away Match Ticket in breach of the Terms and Conditions of Entry in order to gain entry to the Ground or remain at a Match will be considered to be a trespasser and will be refused entry to, or ejected from, the Ground in respect of a particular Match and/or may have his/her Away Match Ticket cancelled or withdrawn. In the event of any cancellation and withdrawal in accordance with this clause 3.5, no refund shall be payable. The Club further reserves its right to take any legal or disciplinary action against any person(s) as it sees fit in connection with such matters, including a claim for an account of any profits made from an unauthorised use of the Away Match Ticket.

3.6 The Club shall have no liability to an Away Match Ticket holder for (i) any interruptions and/or restrictions to the view of any match; and/or (ii) any impact on the Away Match Ticket holder’s enjoyment of any match; in each case which is caused by: (1) the position of the Away Match Ticket holder’s allocated seat; and/or (2) a camera or other filming device(s); and/or (3) the match officials, stewards, police, coaching or catering staff; and/or (4) other ticket holders in the Stadium

4. Changes to Dates, Refunds & Exchanges

4.1 No guarantees can be given by the Club that the Match will take place at a particular time or on a particular date. Subject to clause 4.2 below, the Club reserves the right to reschedule any Match without notice and without any liability whatsoever.

4.2 In the event of the postponement or abandonment of the Match (or if the Match has, for any reason, to be played out of view of the public), you will be entitled to receive a full refund (including any booking and/or administration fee) or receive an equivalent ticket for the subsequent re-arranged Match via such application procedure as the Club stipulates. The Club will have no further liability whatsoever, including (but not limited to) any indirect or consequential loss or damage, loss of enjoyment or travel/accommodation costs.

4.3 In order to obtain a refund, the Away Match Ticket must be returned to the Club's ticket office within 7 days of the rescheduling announcement (which shall be made on the club website) provided this is still more than 7 days before the rescheduled date. A refund will only be issued on production of identification that the individual requesting the refund is the person to whom the Away Match Ticket was originally sold. For the avoidance of doubt, the final decision belongs to the ticket office manager.

5. Lost or Stolen Away Match Tickets
5.1 In order to gain admission to the Ground, the Away Match Ticket must be presented in its entirety at the Match.

5.2 The Club shall not be obliged to issue any replacement for a lost, stolen or destroyed Away Match Ticket.

6. Cancellation & Withdrawal of Away Match Ticket

6.1 Without prejudice to any other remedies it may have, the Club shall have the right in the case of any serious or persistent breach of the Terms & Conditions of Entry to cancel and withdraw any Away Match Ticket issued to you. In the event of such cancellation no refund will be paid. Without prejudice to the general nature of the above, the following actions shall constitute serious breach of the Terms & Conditions of Entry:

  • 6.1.1 smoking in designated non-smoking areas;
  • 6.1.2 being (or appearing to be) drunk or intoxicated;
  • 6.1.3 persistent standing in seated areas whilst the Match is in progress;
  • 6.1.4 the sale or transfer (save as permitted) of an Away Match Ticket to any person;
  • 6.1.5 the deliberate misuse of an Away Match Ticket;
  • 6.1.6 any misrepresentation in relation to clause 1.2 above;
  • 6.1.7 the possession of a banner or flag that bears material or slogans that are offensive, obscene, abusive or racist;
  • 6.1.8 the throwing of any object within the Ground that may cause injury, damage, distress or annoyance to people or property without lawful authority or excuse;
  • 6.1.9 whether at the Ground, or, travelling to a Match:
    • 6.1.9.1 the use of foul, obscene, abusive and/or racist language and/or gestures;
    • 6.1.9.2 the chanting of anything of an indecent or racist nature;
    • 6.1.9.3 fighting, or engaging in and/or inciting violence;
  • 6.1.10 bringing any of the following into the Ground (or using them within the Ground): illegal drugs; other illegal substances; fireworks; firecrackers; smoke canisters; air horns; flares; laser devices; bottles; glass vessels or any item that might be used as a weapon or compromise public safety;
  • 6.1.11 entering the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse;
  • 6.1.12 the supply of any misleading or incorrect information in any application;
  • 6.1.13 any breach of clauses 2.3, 2.4 or 2.5 above; and
  • 6.1.14 any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of any Away Match Ticket.
6.2 The Club may conduct security searches where it has reason to believe that any of the breaches set down in 6.1 has either occurred or may occur.

6.3 If an Away Match Ticket holder is not 16 years old or over, his/her parent(s) and/or guardian(s) are responsible for his/her actions, conduct and compliance with the Terms and Conditions of Entry.

6.4 In the event that your Away Match Ticket is withdrawn or cancelled the Club reserves the right to exclude you from any membership scheme maintained or organised by the Club and/or to disqualify you from applying for any Match ticket or season ticket at its discretion, and to notify any Football Authority and/or other football clubs of such exclusion and/or disqualification (and the reason(s) for such exclusion and/or disqualification).

7. Filming, photography and taping

7.1 All Away Match Ticket holders who enter the Ground acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be taken of them and may also be used, by way of example and without limitation, in televised coverage of the game and/or for promotional, training, editorial or marketing purposes by the Club, the Premier League, or others (including commercial partners and accredited media organisations), and use of an Away Match Ticket to enter the Ground constitutes consent to such use. You further acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be used (by the Club or by a third party, such as a law enforcement body) to identify you as an individual, where permitted by data protection laws, for the purposes of preventing or detecting crime, or any breach of these Conditions of Issue or the Terms & Conditions of Entry.

7.2 All Away Match Ticket holders agree that the Matches for which Away Match Tickets have been purchased are public, and that their appearance and actions inside and in the perimeter of the Ground where a Match occurs are public in nature, and that they shall have no expectation of privacy with regard to their actions or conduct at Matches.

8. Exclusion of Liability

8.1 The Club hereby excludes any liability for loss, injury or damage to persons/property in or around the Ground except in respect of death or personal injury resulting from any negligence of the Club or any other liability of the Club which cannot be excluded under applicable law.

8.2 Neither the Premier League nor the Club shall be responsible for any interruptions and/or restrictions to the view of the Match caused by virtue of (i) the position of the seat and/or (ii) the actions of other spectators.

9. General

9.1 The Club reserves the right to change these Conditions of Issue from time to time, and shall notify you of such changes if they materially affect your rights as a consumer.

9.2 You acknowledge that the Club will hold and process data relating to you, which may include personal data, for administrative and legal purposes. The personal data that you provide to the Club shall be processed, stored and transferred in accordance with the terms of the Club's then current privacy policy available from BrightonAndHoveAlbion.com.

9.3 The invalidity or partial invalidity of any provision of these Conditions of Issue shall not prejudice or affect the remainder of these Conditions of Issue, which shall continue in full force and effect. If any invalid, unenforceable or illegal provision of this agreement would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.

9.4 The Club's failure to exercise, or delay in exercising, any right, power or remedy provided by these Conditions of Issue or by law shall not constitute a waiver of that right, power or remedy.

9.5 The Terms & Conditions of Entry constitute the entire agreement between the Club and the Away Match Ticket holder and neither the Club nor the Away Match Ticket holder shall have any claim or remedy in respect of any statement, representation, warranty or undertaking made by or on behalf of any other party in relation to the Terms & Conditions of Entry which is not set out therein.

9.6 If there is any conflict, ambiguity or inconsistency between any provision of these Conditions of Issue and any provision of the Ground Regulations, the relevant provision of these Conditions of Issue shall take precedence.

9.7 Notwithstanding any other provision in these Conditions of Issue and with the exception of any Football Authority, no other person other than you or the Club has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Conditions of Issue. Nothing in these terms of conditions shall affect any right or remedy of a third party that exists or is available other than as a result of the aforementioned Act.

9.8 These Conditions of Issue and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales in relation to any dispute or claim arising out of or in connection with these Conditions of Issue (including in relation to any non-contractual disputes or claims).

10. Definitions

In the Conditions of Issue the following words and phrases shall have the following meanings:

"Conditions of Issue" means these terms and conditions governing the issue and use of a Home Match Ticket.

"Football Authority" means each of the Premier League, The Football League, The Football Association, The Football Association of Wales, FIFA, UEFA and other relevant governing body of association football.

"Ground" means the football stadium and all other locations owned, occupied or utilised by the Club.

"Ground Regulations" means those ground regulations issued by the Club from time to time that set out the terms and conditions upon which spectators are granted entry to the Ground.

"Guest" means a relative, friend, colleague and/or companion to the disabled who would be entitled to purchase a Home Match Ticket under the Terms & Conditions of Entry.

"Home Match Ticket" means a printed paper ticket or any other form of ticket (and/or any rights arising out of or in connection with any of the foregoing) for admission to the Match.

"Match" means that Premier League football match in which the Club participates and that takes place at the Ground during Season 2019-2020 as designated upon the ticket to which these Conditions of Issue apply.

"Material" means any audio, visual or audio-visual material or any information or data.

"Terms & Conditions of Entry" means each of the rules and regulations of any Football Authority; the Ground Regulations; and the Conditions of Issue.

"Visiting Club" means the football club playing against the Club.

Ground Regulations

GROUND REGULATIONS

Notice: Entry to the Ground is expressly subject to acceptance by the visitor of these Ground Regulations and the rules and regulations of FIFA, UEFA, The Football Association, the Premier League and The English Football League (EFL) in respect of the relevant competition. The Ground Regulations incorporate the Club's Customer Charter (if any). Entry to the Ground shall constitute acceptance of the Ground Regulations.

"Ground" means this football stadium and all locations owned, occupied or utilised by the Club.

"Club" means this football club.

"Match" means any association football match (or any part or aspect of such a match) taking place at the Ground.

"Material" means any audio, visual and/or audio-visual material and/or any information or data.

"Football Authority" means each of the Premier League, The English Football League (EFL) League, The Football Association, the Football Association of Wales, FIFA, UEFA and any other relevant governing body of association football

1 Notwithstanding possession of any ticket the Club, any police officer or authorised steward may refuse entry to (or eject from) the Ground any person:

  • 1.1 that fails (or in the Club's reasonable opinion is likely to fail) to comply with these Ground Regulations or any reasonable instruction issued by a police officer or authorised steward or officer of the Club; and/or
  • 1.2 whose presence within the Ground is, or could (in the Club's reasonable opinion), constitute a source of danger, nuisance or annoyance to any other person.
2 On no account will admission be granted to a person who is the subject of a current Banning Order under the Football Spectators Act 1989 (as amended) or has been convicted of ticket touting offences under the Criminal Justice and Public Order 1994 (as amended).

3 The Club excludes to the maximum extent permitted by law any liability for loss, injury or damage to persons/property in or around the Ground.

4 No guarantees can be given by the Club that a Match will take place at a particular time or on a particular date and the Club reserves the right to reschedule the Match without notice and without any liability whatsoever, save only to the extent provided pursuant to paragraph 5.

5 In the event of the postponement or abandonment of the Match, refunds (if any) will be made in accordance with the Club's Customer Charter. The Club will have no further liability whatsoever, including (but not limited to) any indirect or consequential loss or damage, such as (but not limited to) loss of enjoyment or travel costs.

6 All persons seeking entrance to the Ground acknowledge the Club's right to search any person entering the Ground and to refuse entry to or eject from the Ground any person refusing to submit to such a search.

7 The following articles must not be brought within the Ground - knives, fireworks, smoke canisters, air-horns, flares, weapons, dangerous or hazardous items, laser devices, bottles, glass vessels, cans, poles and any article that might be used as a weapon and/or compromise public safety. Any person in possession of such items will be refused entry to the Ground.

8 Further, you may not bring into the Ground:
  • 8.1 any sponsorship, promotional or marketing materials save in respect of official club merchandise and/or other football related clothing worn in good faith;
  • 8.2 any flags or banners larger than those maximum dimensions permitted by the Club from time to time (or, in the absence of such stipulations, 2 metres x 1 metre) and/or of an offensive nature;
  • 8.3 nor may you offer (either free or for sale by any person) any goods (including literature) of any nature, without the express written approval of the Club's management.
9 The use of threatening behaviour, foul or abusive language is strictly forbidden and will result in arrest and/or ejection from the Ground. The Club may impose a ban for one or more Matches.

10 Racial, homophobic or discriminatory abuse, chanting or harassment is strictly forbidden and will result in arrest and/or ejection from the Ground. The Club may impose a ban for one or more Matches.

11 The following acts are offences under the Football (Offences) Act 1991 (as amended):
  • 11.1 The throwing of any object within the Ground without lawful authority or excuse.
  • 11.2 The chanting of anything of an indecent or racialist nature.
  • 11.3 The entry onto the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse.
Conviction may result in a Banning Order being made.

12 All persons entering the Ground may only occupy the seat allocated to them by their ticket and must not move from any one part of the Ground to another without the express permission or instruction of any steward, officer of the Club and/or any police officer.

13 Nobody may stand in any seating area whilst play is in progress. Persistent standing in seated areas whilst play is in progress is strictly forbidden and may result in ejection from the Ground.

14 The obstruction of gangways, access ways, exits and entrances, stairways and like places is strictly forbidden. Nobody entering the Ground shall be permitted to climb any structures within the Ground.

15 Premier League stadia are smoke-free and smoking or the use of electronic cigarettes is not permitted inside the Ground.

16 Mobile telephones and other mobile devices are permitted within the Ground PROVIDED THAT (i) they are used for personal and private use only (which, for the avoidance of doubt and by way of example only, shall not include the capturing, logging, recording, transmitting, playing, issuing, showing, or any other communication of any Material for any commercial purposes); and (ii) no Material that is captured, logged, recorded, transmitted, played, issued, shown or otherwise communicated by a mobile telephone or other mobile device may be published or otherwise made available to any third parties including, without limitation, via social networking sites.

17 Under the Sporting Events (Control of Alcohol etc.) Act 1985 (as amended), the following are offences for which a person can be arrested by a police officer and conviction could result in a Banning Order being made:
  • 17.1 Attempting to enter the Ground or being inside the Ground whilst drunk;
  • 17.2 Being in possession of any intoxicating liquor, or bottle, can or other portable container and which could cause damage or personal injury, when entering the Ground or in a public area of the Ground from which the event can be directly viewed.
18 Any individual who has entered any part of the Ground designated for the use of any group of supporters to which he does not belong may be ejected from the Ground either for the purposes of his own safety or for any other reason.

19 Save as set out in paragraph 16 above, no person (other than a person who holds an appropriate licence) may capture, log, record, transmit, play, issue, show or otherwise communicate (by digital or other means) any Material in relation to the Match, any players or other persons present in the Ground and/or the Ground, nor may they bring into the Ground or use within the Ground (or provide to, facilitate or otherwise assist another person to use within the Ground) any equipment or technology which is capable of capturing, logging, recording, transmitting, playing, issuing, showing or otherwise communicating (by digital or other means) any such Material.

20 The copyright, database rights and any other intellectual property rights in and to all Material that you produce at the Ground in relation to the Match, any players or other persons present in the Ground and/or the Ground (whether produced in breach of paragraph 19 above, or pursuant to paragraph 16 above, or otherwise) is hereby assigned (including by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs and Patents Act 1988) to the Club and the Premier League. You further agree (if and whenever required to do so by the Club and/or the Premier League) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to the Club and the Premier League absolutely and with full title guarantee.

21 No goods (including literature) of any nature may be offered either free or for sale by any person within the Ground without the express written permission of the Club.

22 Tickets are not transferable and may not be offered for sale without the prior written permission of the Club or otherwise in accordance with the relevant ticket terms and conditions. Any tickets that are transferred are transferred subject to these Ground Regulations. Any tickets offered for sale may be confiscated by any steward, officer of the Club or any police officer. The Club reserves the right to refuse admission to or eject from the Ground, and/or "blacklist", any person who has offered for sale or transferred his/her ticket in contravention of the relevant ticket terms and conditions (and/or the holder of any ticket that has been transferred in contravention of the relevant ticket terms and conditions). Tickets remain the property of the Club at all times.

23 CCTV cameras are in use around and in the Ground. Body worn video cameras recording video and/or audio may also be used as appropriate, to record images or audio which identifies you as an individual, for example to record prohibited behaviours as referenced in paragraphs 9 and 10. The Club may itself use or pass to the police or any Football Authority or other clubs, any recordings for use in any proceedings.

24 At all times whilst present in the Ground, persons must comply with any and all instructions of any steward or officer of the Club and/or any police officer. Failure to comply with any instruction may lead to immediate ejection from the Ground.

25 By entering the Ground, all persons are acknowledging that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom ) may be taken of them and may also be used, by way of example and without limitation, in televised coverage of the game and/or for promotional, training, editorial or marketing purposes by the Club, the Premier League or others (including commercial partners and accredited media organisations) and entry into the Ground constitutes consent to such use. You further acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be used (by the Club or by a third party, such as a law enforcement body) to identify you as an individual, where permitted by data protection laws, for the purposes of preventing or detecting crime, or any breach of these Ground Regulations. Information about the Club's use of your personal data will be brought to your attention by the Club (see for example any applicable privacy policy, signage and/or other forms of announcement in or around the ground). 26 All ticket holders agree that the Matches for which the tickets have been purchased are public, and that their appearance and actions inside and in the perimeter of the Ground where a Match occurs are public in nature, and that they shall have no expectation of privacy with regard to their actions or conduct at Matches.

27 Further to paragraph 25, if such person is under 18 years of age, the parent, guardian, or responsible adult who is accompanying them into the Ground shall be deemed to have provided consent on their behalf.

28 Refused entry to (or ejection from) the Ground may lead to further action by the Club including, but not limited to, the withdrawal of any season ticket (without reimbursement), Club Membership and other benefits.

MyAlbion+ Memberships 2019/20

1 Brighton & Hove Albion membership cards are not transferable. A membership card is only valid when used by the person to whom it is registered. Any breach of this term will entitle the club to demand the surrender and cancellation of the membership card with no refund issued.

2 The membership card remains the property of Brighton & Hove Albion FC. Membership cards may not be sold, exploited for commercial use, or used for promotional purposes or campaigns without the express written permission of the club.

3 All Brighton & Hove Albion membership schemes are seasonal. The respective fee for each membership is therefore valid for one season only. Memberships purchased for use during the season shall expire on 31 May or immediately after the last game of the season, whichever is sooner.

4 The membership fee will not be reduced for new applicants wishing to join at any point once the season is underway.

5 The club cannot accept any responsibility for membership cards that are lost or destroyed. Lost membership cards should be reported immediately to the Membership Department on 0844 327 1901. Replacements will only be issued at the discretion of the Head of Ticketing and at a cost of £15.

6 All members must comply with Brighton & Hove Albion FC Ground Regulations and Match Ticket terms and conditions. Any violation of these may result in membership being withdrawn or cancelled.

7 All Adult membership applicants based in the UK must be on the electoral register and living at the address given on application. Brighton & Hove Albion FC reserves the right to refuse an application if the name of the applicant is not registered at their stated address. The club also reserves the right to cancel without refund any memberships that are discovered to be registered to addresses that are not the primary residence of the card holder.

8 In the event of a cup-tie, members joining once the draw has taken place will not be eligible to obtain ticket priority for that fixture.

9 Brighton & Hove Albion membership offers a level of ticket priority for home and away games, dependent on demand Loyalty Points may be used as a means of determining eligibility. Existing ticket purchasing history may also be required for some matches.

10 The number of tickets available to purchase by individual members may vary on a match to match basis. It is the responsibility of the member to find out when tickets go on sale for each game, when the members' priority booking period commences and how many tickets they are able to purchase for that game. The club will do its utmost to ensure that every available club communication channel is utilised to provide ticketing information.

11 A maximum of 4 membership cards may be used in one transaction (i.e. no more than 4 cards can be presented in one application).

12 Brighton & Hove Albion priority membership does not guarantee a ticket to each game. It is recommended that you book your ticket at your earliest convenience to maximise your chances of success.

13 All rights to priority regarding ticket sales for away games are at the discretion of the Club and membership does not guarantee tickets for any specific game.

14 Ticket priority for MyAlbion+ Members for away match tickets and home cup games will follow Season Ticket Holders, the Club will identify the sales windows on a match-by-match basis.

15 If Brighton & Hove Albion FC suspects for any reason that the card is being used fraudulently to obtain matchday tickets, then the club retains the right to ban the offending individual(s) from the Club.

16 No refunds will be given in respect of membership fees.

17 If you are convicted of a ticketing offence, or we suspect you have committed a ticketing offence, we will notify the appropriate Football Authorities who in turn may notify the UK Football Policing Unit. The information that we share may include your personal data, information about the offence and about ticket purchases. We will use this to identify and prevent ticketing offence and disorder at matches. If you have any queries about this, please contact our Ticket Office.

18 Memberships will be processed within 14 working days. Membership benefits will not begin until after the membership has been processed.

19 Young Seagulls must be signed up as Young Seagulls Members for at least the full season prior to their 7th birthday in order to qualify for their birthday shirt. The birthday shirt voucher is subject to its own terms and conditions.

20 All tickets purchased using the membership benefits must be for the sole use of the person to whom the seat is assigned.

21 The club reserves the right to amend these terms and conditions at any time.

22 Any MyAlbion+ Membership prizes won over the season are non-transferable..

23 MyAlbion+ Members and Brighton & Hove Albion match-ticket purchasers must at all times do everything within their power and control to protect and enhance the good name of the Club and not to diminish or besmirch the good name of the Club in any way or through any means. This includes, but is not restricted to, conduct at any Brighton & Hove Albion fixture, including the first-team, under-23s, women's and academy teams; all club events; while travelling to and from any match or event; and conduct on social media. The Club also does not tolerate foul and/or abusive behaviour towards staff either in person, or via any form of communication with Club staff, including telephone, email and social media. Anybody in breach of these rules, can expect a lengthy and potential life ban, depending on the severity of the breach.

24 Supporters purchasing membership via Direct Debit agree to the automatic renewal of their Membership on 1st June for subsequent Seasons in accordance with paragraph 25.

25 Members who purchased via Direct Debit may cancel the automatic renewal of their Membership prior to 5pm on 22 May in the relevant year, without liability to make further payments. After 22 May membership for the next seasons membership cannot be cancelled until the renewal period opens for the following season.

Season Ticket Waiting List Membership

  • 1 To be part of the season ticket waiting list, you must be a MyAlbion+ Member. Membership must be renewed prior to 1 June each season in order to maintain your position or move up the list should any supporters above you decide not to renew their membership.

  • 2 If a supporter wishes to be adjacent to another supporter on the waiting list, they must apply for MyAlbion+ Membership at the same time.

  • 3 Only one seat will be granted to each person on the waiting list. Therefore, a MyAlbion+ Membership must be purchased for each supporter wishing to be on the waiting list for a season ticket.

  • 4 In the event that a Member is offered a season ticket, they will have two working days to decide if they wish to purchase it.

  • 5 If season tickets become available to the Family Stand, these will only be offered to MyAlbion+ Adult Members who are accompanying MyAlbion+ Junior (U18) Members. The conditions outlined in clause 4 still apply.

  • 6 The club reserves the right to offer season tickets as prizes for promotions from time to time.

  • 7 In the event a season ticket is made available and offered to you, this will be for the limited choice of locations the club has at the time. If you choose to reject the seat available you may maintain your position on the waiting list for one more season. In the event a season ticket is offered to you, you will only be given one opportunity to buy in any given season and if you reject the option to purchase on 2 occasions you will then be moved to the bottom of the waiting list.

Ticket Gift Vouchers

1 Ticket Gift Vouchers can be redeemed online at www.brightonandhovealbion.com/tickets, by telephoning the Albion Booking Line on 0844 327 1901*, or in person at the Ticket Office in the Seagulls Store, American Express Community Stadium. In all cases you must use the unique voucher number to redeem your voucher.

2 Gift vouchers are valid for the purchase of tickets for Brighton & Hove Albion FC home league games, season tickets, memberships and Stadium Tours. Vouchers cannot be used to purchase away or cup match tickets, merchandise or catering.

3 Gift Vouchers may be used to make payment for items below the value of the voucher (phone / in person only). Vouchers should be retained. The remaining balance can be used for future purchases.

4 Gift Vouchers are not exchangeable for cash or another voucher.

5 Gift vouchers will not be replaced if lost, damaged or stolen.

6 Gift vouchers are valid for 12 months from the date of purchase, and must be redeemed by the expiry date printed on the voucher.

7 BHAFC reserves the right to amend these terms and conditions without prior notice.

Mascots

1 Mascots will receive the following included in the mascot package

  • (i) 1 adult ticket (2 adult tickets if purchasing the captains package) and 1 U18 ticket in home area seating
  • (ii) an opportunity for the purchaser who is aged between 7 and 12 (inclusive) on the date of the Match to be an official mascot at the Match (the “Mascot”);
  • (iii) a Brighton and Hove Albion replica kit for the Mascot, comprising of a shirt, shorts and socks;
  • (iv) a photograph commemorating the Match;
  • (v) meal vouchers offering a hot food item, snack and drink for 1 adult (2 adult if purchasing the captains package) and 1 junior ;
  • (vi) a parking pass for the Bridge car park for the captains mascots
2 The Mascot's role at the Match will be at BHAFC's absolute discretion. BHAFC gives no guarantee as to which football team or football player a Mascot may be assigned to at the Match. BHAFC will not enter into any correspondence as to which football team or football player a Mascot may be assigned to at the Match.

3 Each mascot and each of the mascots guest(s) will be required to comply with any policies, procedures, terms, conditions and reasonable requirements of BHAFC which apply to the use of the facilities at the Stadium and / or attendance at the Match. BHAFC reserves the right to eject a mascot and/or a mascots guest(s) from the Match and / or the Stadium in the event of any breach of any such policies, procedures, terms, conditions and / or requirements.

4 One of the guests that accompany that mascot to the Match must be 18 years of age or older on the date of the Match.

5 BHAFC reserves the right to substitute any or all of the items included in the mascot package with others of a similar nature and/or of equal or greater value at any time.

6 The mascot package is non-refundable and non-transferable.

7 No guarantees can be given by the Club that a Match will take place at a particular time or on a particular date. The Club reserves the right to reschedule any Match without notice and without any liability whatsoever. Your mascot package will enable you to attend the re-arranged Match. In the event of reschedule, the package will be valid for the rescheduled date and an alternative match will not be offered.

8 The Club will have no further liability whatsoever, including (but not limited to) any indirect or consequential loss or damage, loss of enjoyment or travel/accommodation costs.

9 We do not offer refunds on mascot packages unless under exceptional circumstances. For the avoidance of doubt, the final decision belongs to the Head of Ticketing & Supporter Services.

10 Each mascot and their guest(s) will be required to give their consent to the following:
  • (i) for the mascot and their guest(s)'s names to be disclosed and/or photographs to be published
11 If BHAFC cannot successfully contact a mascot within a reasonable length of time, or if a mascot does not meet the eligibility requirements, a replacement mascot will be found who is able, willing and eligible to accept the mascot package and provide the necessary consents.

12 Upon the request of a mascot (such request to be made no later than 30 days prior to the Match), and upon receipt of the relevant tickets by BHAFC, BHAFC will refund that mascot the face value of up to four standard match tickets that that mascot had purchased for the Match prior to purchasing the mascot package.

13 For safeguarding reasons, home and away match day mascots will not be allowed access to the changing rooms whilst they are in use and players will be unable to sign any merchandise or items that you bring on the day or leave with staff to have signed after the event.

14 We are unable to allow parents pitch side whilst the mascot is on the pitch, parents/guardians may go the allocated seating area by swiping the tickets in via the turnstile that corresponds to your match ticket.

15 Mascot packages are restricted to one per fan number per season.

16 The application and safeguarding form must be submitted (signed) to supporter services at least 14 days before the fixture. We may be unable to fulfil the package in the event that this is not returned pre match.

17 Match day kit will be allocated to mascots depending on their age - if the mascot requires a much larger/smaller kit, supporter services must be informed at least 14 days before the event by emailing supporter.services@bhafc.co.uk (subject to availability)

18 The package can only be utilised by the supporter whose fan number the mascot package has been purchased in, we are within our right to cancel any package where the child's details do not match details held against the fan number.

19 By submitting the application the mascot will be enrolled into the Young Seagulls Membership (where applicable).

20 The mascot must have the relevant priority to purchase the package – 1901 members can only book if the child regularly uses the ticket to watch the games.

21 BHAFC reserves the right to cancel or amend these Conditions without notice when reasonably necessary for the purpose of administering the mascot package.

Matchday Hospitality


1 DEFINITIONS

1.1 IN THIS AGREEMENT the following expressions shall have the meanings shown:

  • 1901 Club Hospitality Terms and Conditions means the terms and conditions as set out below which apply to all Hospitality Packages.

  • Agreement means the agreement between the Purchaser and the Company for the purchase of a Hospitality Package which includes the 1901 Club Hospitality Terms and Conditions and the Terms of Entry.

  • Booking Confirmation means the notice issued by the Company to the Purchaser confirming the successful booking of a Hospitality Package.

  • Business Days means a day (other than a Saturday or Sunday) on which the banks are ordinarily open for business in the City of London.

  • Car Park Space means a car park space allocated to the Purchaser by the Company within the Designated Car Parking in accordance with clause 10.

  • Club Website means www.brightonandhovealbion.com

  • Company means Brighton & Hove Albion Football Club Limited.

  • Designated Areas means the Seat(s), Hospitality Areas and Designated Car Parking (if any) included in the Hospitality Package.

  • Designated Car means the car parks on the campus of Sussex University or elsewhere designated by the Company for use by the Purchaser, where provided as part of the Hospitality Package.

  • Designated Car Parking Pass means such form of documentary evidence issued by the Company permitting the Purchaser to use the Designated Car Parking, where provided as part of the Hospitality Package.

  • Dress Code means smart business attire. Acceptable attire includes smart jeans and shoes but please note that, for example, ripped jeans, flip flops or trainers are not permitted. Men must wear a collared shirt or polo shirt. Football shirts, polo-necks and sweatshirts are not permitted with the exception of children aged 14 years old and under who are permitted to wear replica Brighton and Hove Albion football shirts.

  • Football Authority means each of the Premier League, EFL, The Football Association, FIFA, UEFA and any other relevant governing body of association football.

  • Force Majeure means any cause affecting the ability of the Company to provide the Hospitality Package arising from or attributable to any acts, events, omissions, incidents or accidents beyond the reasonable control of the Company.

  • Ground Regulations means the ground regulations adopted by the Company at the Stadium at the time of a Relevant Event (which may include regulations issued by a Football Authority). The Ground Regulations can be viewed at the Stadium, accessed via www.brightonandhovealbion.com or provided by the Company on request.

  • Guest means any individual(s) who the Purchaser is authorised to invite to attend the Relevant Event with the Purchaser as part of the Hospitality Package in accordance with this Agreement.

  • Home Match Ticket Terms & Conditions means the terms and conditions governing the issue and use of home match tickets which are available at www.brightonandhovealbion.com

  • Hospitality Areas means the 1901 Club and the areas within the Stadium, including restaurants, where hospitality services are available to the Purchaser as part of the Hospitality Package.

  • Hospitality Package means use of the Designated Areas at a single Relevant Event as set out in the Booking Confirmation.

  • Hospitality Package Price means the total price of the Hospitality Package as set out in the Booking Confirmation plus VAT.

  • Opening Hours means the periods during which the Designated Areas, Designated Car Parking, Hospitality Areas and Stadium remain open for a Relevant Event.

  • Purchaser means the purchaser of a Hospitality Package, being an individual or corporate entity.

  • Relevant Events means all ticketed Brighton & Hove Albion Football Club men's senior first team matches held at the Stadium, including all league games and domestic and European cup matches, excluding testimonial matches and friendlies.

  • Relevant Legislation means any Act of Parliament and any European Community Legislation or decree or any other legislation or decree having effect as law in the United Kingdom; reference to Relevant Legislation shall include any statutory modification or re-enactment for the time being of any enactment and any orders or regulations or permissions or directions made or issued under it or any enactment replaced by it or deriving validity from it.

  • Seat(s) means the seat(s) in the Stadium allocated to the Purchaser as part of the Hospitality Package.

  • Stadium means the American Express Community Stadium, Village Way, Brighton, BN1 9BL.

  • Terms of Entry means the Home Match Ticket Terms & Conditions and the Ground Regulations

  • Ticket means any ticket, voucher, booklet, card or other such entry materials which are provided by the Company to the Purchaser to enable the Purchaser (and its Guests if applicable) to use the relevant Hospitality Package.
2 BOOKING AND PAYMENT TERMS

2.1 By booking and paying for a Hospitality Package, the Purchaser is acknowledging that it has carefully read, understood and agrees to be bound by the 1901 Club Hospitality Terms & Conditions and the Terms of Entry which together shall constitute the Agreement between the Purchaser and the Company in respect of the Hospitality Package.

2.2 The Company cannot reserve any Hospitality Packages in advance. Payment must be made in full at the time of booking.

2.3 Purchasers of Hospitality Packages must be aged 18 or over at the time of purchase.

2.4 Hospitality Packages must be booked by telephone by calling 01273 878 278 or 0844 327 1901 and paid for using a debit or credit card. 1901 Club members will also be able to book Hospitality Packages online via www.brightonandhovealbion.com/en-gb/categories/hospitality.

2.5 If a booking is accepted, the Company will send the Purchaser a Booking Confirmation within 10 Business Days of receipt of the Hospitality Package Price.

2.6 A legally binding agreement shall be formed between the Company and the Purchaser upon the Company issuing the Booking Confirmation.

2.7 Hospitality Packages are personal to the Purchaser and cannot be transferred or resold without the prior written consent of the Company. If the Purchaser purchases more than one Hospitality Package then the Purchaser can invite Guest(s) to use the Hospitality Package in accordance with clause 3.

2.8 The Purchaser is responsible for notifying the Company about any special dietary requirements (e.g. allergies, intolerances) for the Purchaser and its Guests no later than five (5) Business Days prior to the Relevant Event.

3 GUESTS

3.1 The Purchaser is responsible for making its Guests aware of the 1901 Club Hospitality Terms and Conditions and the Terms of Entry and ensuring their compliance with the same.

3.2 If the Purchaser or any Guest is in breach of this Agreement, the Company reserves its right to take one or more of the following steps which it in its absolute discretion deems appropriate: (i) evict the person from the Stadium; (ii) withdraw and cancel any Ticket or Hospitality Package; (iii) issue limited or lifetime bans; (iv) report the matter to the Football Authorities who in turn may notify other Football Authorities and/or the UK Football Policing Unit; (v) report the matter directly to the police; and/or (vi) take legal action. In any of these circumstances, no refund of all or any part of the Hospitality Package Price will be paid by the Company. The Purchaser also acknowledges that it may face action from the police in the event of certain of these breaches which may, among other things, render it liable to a fixed penalty fine and/or criminal prosecution.

4 DRESS CODE

4.1 The Company operates a strict Dress Code in relation to Hospitality Packages which the Purchaser and its Guests must adhere to at all times.

4.2 The Company reserves the right to refuse admission and/or eject from the Stadium the Purchaser and/or its Guests if (in the Company's sole opinion) they are in breach of the Dress Code.

4.3 The Company will not provide alternative seating or any financial compensation to the Purchaser or any Guest who is refused admission or ejected from the Stadium due to a breach of the Dress Code.

5 ETIQUETTE AND STANDARDS OF BEHAVIOUR

5.1 The Purchaser and its Guests must abide by the 1901 Club Hospitality Terms and Conditions and the Terms of Entry and agree not to do anything or procure anything to be done that will or is likely to bring the name or reputation of the Company or Brighton & Hove Albion Football Club into disrepute.

5.2 Whilst the Company accepts that some Guests may favour the away team, the Seats provided as part of the Hospitality Package are within the home supporters' area in the Stadium and therefore Guests must respect their surroundings at all times.

5.3 The Company reserves the right to eject from the Stadium the Purchaser and/or any of its Guests that behave in a loud, disorderly, unruly or abusive manner or otherwise breach the Terms of Entry and shall not be required to pay any compensation to the Purchaser or any Guest as a result of any such ejection.

5.4 The Purchaser and its Guests are prohibited from bringing into or consuming in the Stadium any food or drink (whether alcoholic or otherwise) that has not been provided by the Company.

5.5 Children under the age of 18 are permitted within the Designated Areas but they must be accompanied by a responsible adult at all times.

5.6 The Company reserves the right to charge the Purchaser the cost of rectifying damage caused by the deliberate, negligent or reckless act of the Purchaser or its Guests to the Stadium (including the Designated Areas).

5.7 The Purchaser and its Guests will not have the opportunity to leave and re-enter the Stadium. The Company operates a strict policy prohibiting re-admission to the Stadium.

6 CANCELLED OR RE-ARRANGED RELEVANT EVENTS

6.1 The Company cannot guarantee that the Relevant Event will take place at a particular time or on a particular date.

6.2 The Company shall not be liable for any loss, damage or expense (including any indirect or consequential loss or damage, loss of enjoyment or travel/accommodation costs), arising out of or in connection with a Relevant Event being cancelled, postponed, curtailed, abandoned or subject to change of schedule for any reason whatsoever, including due to the rescheduling of fixtures or otherwise due to circumstances beyond the reasonable control of the Company.

6.3 The Company will use reasonable endeavours to inform the Purchaser of any postponement or cancellation (for example, in writing or by issuing a notice via the Club Website) prior to the Relevant Event.

6.4 If a Relevant Event is cancelled, postponed or rescheduled, the Company will offer the Purchaser one of the following (at the Company's discretion):
  • (a) the option to attend the re-arranged Relevant Event. The Company will have no further liability whatsoever to the Purchaser and its Guest(s); or
  • (b) the option of an alternative hospitality package of a comparable standard to the Hospitality Package for another Relevant Event; or
  • (c) a full refund of all payment made by the Purchaser to the Company in respect of such cancelled or postponed Relevant Event.
6.5 The Company reserves the right to vary the provision and Hospitality Package in accordance with licensing restrictions in the event of a change in kick off times of any Relevant Event.

6.6 Save as set out in this clause 6, no refunds will be made in respect of a Relevant Event not attended, postponed, abandoned, delayed or rescheduled to accommodate live television coverage or for any other reason, or in any circumstance where the Company has cancelled a Hospitality Package or Ticket as a result of a Purchaser's conduct or otherwise for a breach of the Agreement.

7 CANCELLATION OR AMENDMENTS BY PURCHASER

7.1 The cancellation rights granted to consumers pursuant to The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 do not apply to Hospitality Packages. Consequently, consumers will not be able to cancel their Hospitality Package except in accordance with this Agreement or as otherwise permitted by law.

7.2 If the Purchaser wishes to cancel or alter a booking after the Company has issued a Booking Confirmation it can submit a request to the Company in writing. The Company shall be entitled to grant or withhold its approval in its sole discretion and to make approval conditional on the Purchaser agreeing to pay additional fees if necessary.

7.3 If the Company agrees to cancellation by the Purchaser, subject to the Purchaser giving ten (10) Business Days notice to the Company prior to the Relevant Event, the Purchaser will receive a full refund. The Company will refund to the Purchaser 75% of the Hospitality Package Price if the Purchaser cancels less than ten (10) Business Days before the Relevant Event.

7.4 The cancellation amounts and/or any charges set out in this clause 7 represent a genuine reasonable pre-estimate of loss and proportionate protection to compensate the Company for all losses incurred as a result of such cancellation.

8 MATCH DAY

8.1 The Purchaser and its Guests must present a Ticket in order to gain entry to the Stadium and Designated Areas.

8.2 The Purchaser and its Guests will only be granted admission to the Stadium and Designated Areas during the Opening Hours of the Relevant Event.

8.3 It is the responsibility of the Purchaser to check:
  • (a) that the Company holds the correct details for the Purchaser and its Guest(s) and that the correct details appear on each Ticket; and
  • (b) the date and time of the Relevant Event, which may be subject to alteration.
8.4 The Company reserves the right in its sole discretion to allocate alternative seats, rooms and facilities or services to the Purchaser (for example, when relocation is necessary for operational reasons). In the event of such change, the Company shall endeavour to provide a suitable replacement of equal or greater value than the Hospitality Package purchased.

8.5 The purchase of a Hospitality Package does not grant the Purchaser or its Guests exclusive use or possession of any part of the Stadium, Designated Areas, and Hospitality Areas or create a tenancy in kind.

9 TICKETS

9.1 Tickets are issued subject to the Terms of Entry which the Purchaser acknowledges it must adhere to and which form part of this Agreement.

9.2 Tickets remain the property of the Company at all times. The Company reserves the right to withdraw or require the immediate return of any Ticket at any time.

9.3 The Company is not responsible for any Ticket which is lost, stolen, forgotten, damaged, defaced or destroyed (whether a Ticket is damaged, defaced or destroyed shall be determined by the Company acting reasonably in its sole discretion). The Company is not obliged to issue replacement tickets but if it decides to do so it may charge an administration fee for each ticket which is replaced.

9.4 The Purchaser is prohibited from using a Hospitality Package for promotional, advertising or marketing purposes unless expressly authorised in writing by the Company.

9.5 The unauthorised sale or disposal of any Ticket may amount to a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. The Company will inform the police as soon as it becomes aware that a Ticket and/or Hospitality Package are being or have been sold in contravention of this law and may share information of any persons involved (or whom it reasonably believes are involved) with the police and, as applicable, Football Authority. The Company reserves the right to suspend or withdraw with no refund any Hospitality Package purchased by any person who is convicted of a criminal offence related to the illegal sale of tickets or is reasonably suspected by the Company of committing such an offence.

10 CAR PARKING

10.1 Subject to availability, the Company may agree to provide the Purchaser with one (1) Car Parking Pass for every four (4) Hospitality Packages purchased to each Relevant Event. This Car Parking Pass must be produced at the Relevant Event in order to gain access to the Car Park Space.

10.2 The Company is not responsible for any Car Parking Pass which is lost, stolen, forgotten, damaged, defaced or destroyed. The Company may, in its absolute discretion, provide a replacement pass (or a pass for a different car parking space) and reserves the right to charge an administration fee in respect of any replacement issued.

10.3 Vehicles are parked at the risk of the Purchaser and the Company shall not be liable for any theft, loss or damage to any vehicle or its contents.

10.4 Car Park Passes are personal to the Purchaser and cannot be sold, transferred or assigned without permission of the Company.

11 LIABILITY

11.1 Subject to clause 11.5, the Company will not be liable to the Purchaser (or any Guest) for any loss or damage of any nature arising from any breach of an express or implied warranty, term or condition of this Agreement or any negligence, breach of statutory or other duty on the part of the Company or in any other way arising out of or in connection with this agreement, except in accordance with these 1901 Club Hospitality Terms & Conditions.

11.2 Subject to clause 11.5, the Company shall not be liable for: any loss suffered as a result of the exercise by the Company of its rights under this Agreement; (ii) any loss, damage or injury to the Purchaser (or any Guest) including any property belonging to the Purchaser (or any Guest) in or around the Stadium (including its approaches and Designated Car Parking) however caused; (iii) any loss, damage or injury to the Purchaser (or any Guest) caused by this Agreement; (iv) any indirect, incidental, special or consequential liability; (v) any loss of profits, loss of use, loss of opportunity or loss of or damage to goodwill; (vi) any losses arising from any interruptions and/or restrictions to the view of or enjoyment of a Relevant Event; or (vii) any loss incurred arising out of or in connection with any cancelled, postponed, rearranged or abandoned Relevant Event.

11.3 Subject to clause 11.5, the Company's total aggregate liability to the Purchaser (and its Guests) in respect of all matters arising out of or in connection with the Agreement shall not exceed a sum equivalent to the Hospitality Package Price.

11.4 The Company shall have no responsibility for any Guests' property that is left unattended in the Designated Areas. Any property left unattended is at the owner's risk.

11.5 Nothing in this Agreement shall limit either party's liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation.

12 DATA PROTECTION

12.1 The Purchaser and its Guests acknowledge and agree that the personal data provided by them to the Company in the purchase and use of a Hospitality Package shall be collected, stored and used by the Company in accordance with Relevant Law and the Company's privacy policy (available at the Club Website).

12.2 The Purchaser and its Guests acknowledge that photographic images and/or video recordings (and/or stills taken from video recordings) may be taken of them and may also be used in televised coverage of a Relevant Event and/or for promotional or marketing purposes by the Company, Football Authority or other third parties (such as event promoters) and use of a Ticket to enter the Stadium constitutes consent to such use.

13 FORCE MAJEURE

The Company shall not be deemed to be in breach of this Agreement or otherwise liable to the Purchaser as a result of any delay or failure in the performance of its obligations under this Agreement if and to the extent that such a delay or failure is caused by a Force Majeure Event.

14 INDEMNITY AND COSTS

If the Purchaser is not a consumer, the Purchaser agrees to indemnify, and keep indemnified, the Company against any losses (of whatever nature and however caused or incurred), damages, liability, costs (including legal fees) and expenses incurred by the Company as a result of or in connection with the acts or omissions of the Purchaser (or any Guest(s)) which are in breach of (or otherwise contrary to) the terms of this Agreement and/or any damage caused by the Purchaser and/or its Guest(s) to the Stadium or any property, equipment or facilities at the Stadium.

15 GENERAL

15.1 In the event that any of these 1901 Club Hospitality Terms and Conditions are declared void, ineffective or unenforceable by any competent court, the remainder of the 1901 Club Hospitality Terms and Conditions shall remain in effect as if such void, ineffective or unenforceable condition or conditions had not been included.

15.2 The Company reserves the right to make amendments to the 1901 Hospitality Terms and Conditions, the Home Ticket Terms & Conditions and the Ground Regulations from time to time. Up to date versions of these documunts shall be available to access at www.brightonandhovealbion.com

15.3 The Company's failure to exercise, or delay in exercising, any right, power or remedy provided by this Agreement or by law shall not constitute a waiver of that right, power or remedy.

15.4 The Booking Confirmation including these 1901 Club Hospitality Terms and Conditions and documents referred to herein, comprise the entire agreement between the Company and Purchaser in relation to the purchase and use of Hospitality Packages.

15.5 The Company and its group companies shall be entitled to enforce these 1901 Club Hospitality Terms and Conditions against the Purchaser (and its Guests). The Company shall at any time be entitled to assign, transfer or novate the benefit and subcontract the obligations due under these 1901 Club Hospitality Terms and Conditions.

15.6 Except as expressly set out in this Agreement, no third party shall have any rights under this Agreement by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise.

15.7 The Agreement (including without limitation the 1901 Club Hospitality Terms and Conditions) shall be governed by and interpreted in accordance with the laws of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales.
